Terms of Service

These Terms of Service ("Terms") govern your use of the website at www.jerdurf.shop (the "Site") operated by NSY REAL ESTATE, LLC ("NSY," "we," "us"), a Utah limited liability company at 949 N 900 W, Tremonton, UT 84337. By browsing the Site or submitting an inquiry, you accept these Terms. If you do not agree, do not use the Site.

1. What This Site Is

The Site is an informational window for a brokerage office: it describes our rails, services, duties and how to reach the desk. It is not a listing service, an offer system, a property database or a marketplace. Nothing on the Site constitutes an offer of brokerage services at particular terms; engagement begins only under a signed representation agreement.

2. No Agency by Browsing

Viewing a card, sending an inquiry slip, or exchanging messages with the desk opens a conversation — not an agency relationship, buyer representation or listing. An agency relationship is created only by a written agreement signed by the authorized parties. Do not rely on brokerage advice before that signature; general information exchanged in inquiry is not transaction advice.

3. No Property Offered Through This Site

The Site advertises services, not real estate. No listing, price, property description or availability shown anywhere on the Site is an offer to sell, lease or auction real property. Any actual listing terms, prices and property information are provided in transaction documents under the applicable agreement and disclosures — and may change or be withdrawn without notice.

4. Representation & Disclosures — Read This Carefully

  • Agency sides: buy-side and sell-side representation carry different fiduciary duties; the engagement letter states which client we serve and what duties attach.
  • Dual/limited agency: where the law permits multiple-party representation, it proceeds only with required written disclosures and consents.
  • Specialty lines: auction and time-share transactions carry additional rules, disclosures and rescission rights that apply as written in their governing documents.
  • Not legal/tax/lending advice: brokerage services inform a transaction; contracts, tax treatment, financing and title questions belong to your attorney, accountant, lender and title company respectively.
  • License status: services are performed under Utah real-estate license law and applicable MLS and association rules.

5. Fair Housing

NSY serves clients under the federal Fair Housing Act, the Utah Fair Housing Act and all applicable civil-rights laws. We do not discriminate on any protected basis and do not accommodate requests that would. An inquiry that asks us to steer, exclude or discriminate is declined and documented.

6. Acceptable Use

You agree not to: scrape or bulk-harvest the Site's content; probe, scan or attack the Site or its hosting; submit false, misleading or fraudulent inquiries (including fake offers, phishing or wire-fraud pretexts); misrepresent your identity, authority or funds; or use the Site in any way that violates applicable law. We may block access and report unlawful conduct.

7. Intellectual Property

The Site's text, layout, illustrations (including the window-display and listing-card artwork), branding and the "Window" design system are the property of NSY REAL ESTATE, LLC or its developer and are protected by copyright and other laws. You may view and share links to the Site; you may not reproduce, republish or adapt its content or artwork without written permission.

8. Third-Party Links & Services

The Site may link to third-party sites or rely on third-party infrastructure (hosting, fonts). We do not control and are not responsible for third-party content, policies or availability. Following a link is at your own discretion.

9. Disclaimers

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components, or that any service or transaction will be available as described.

10. Limitation of Liability

To the maximum extent permitted by law, NSY REAL ESTATE, LLC and its members, managers, agents, employees and developer are not liable for indirect, incidental, consequential, special or punitive damages — including lost profits, lost deals or business interruption — arising from or related to use of the Site or reliance on its content. Our total aggregate liability for claims arising from the Site shall not exceed one hundred U.S. dollars (US$100). Nothing in this section limits liability that cannot be limited by law.

11. Indemnification

You agree to defend, indemnify and hold harmless NSY REAL ESTATE, LLC from claims, losses and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site, or your breach of applicable law — including fraudulent inquiries or misrepresentation of authority.

12. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules, and by applicable U.S. federal law. Real-estate license, brokerage and fair-housing rules apply as written, and nothing here overrides them.

13. Disputes

Any dispute arising from the Site or these Terms shall be brought exclusively in the state or federal courts located in or covering Box Elder County, Utah, and you consent to their jurisdiction. Before filing, the parties will attempt good-faith resolution through the broker's desk for at least thirty days. Any claim must be brought within one year after it accrues or is barred.

14. Severability, Waiver & Changes

If a provision of these Terms is held unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. We may update these Terms; the current version is posted here and material changes take effect on posting unless stated otherwise.
